CanWeSail is a weather forecasting platform designed for sailors. The Service aggregates meteorological data from various sources and provides personalized forecasts, alerts, and sailing condition analysis. The Service is provided for informational purposes only.

3. Disclaimer of Warranties

IMPORTANT: Weather forecasting is inherently uncertain. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

  • The forecasts or predictions will be accurate, complete, or reliable
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will meet your requirements
  • Any errors in the Service will be corrected

Weather conditions can change rapidly and unpredictably. Always verify conditions through official sources and exercise proper judgment before sailing. Never rely solely on this Service for safety-critical decisions.

4. Limitation of Liability

To the maximum extent permitted by law, Full Stack (Pty) Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or other intangibles
  • Property damage or personal injury
  • Decisions made based on information provided by the Service
  • Any maritime incidents or accidents

Our total liability shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

5. User Responsibilities

As a user of the Service, you agree to:

  • Provide accurate account information
  • Maintain the security of your account credentials
  • Use the Service only for lawful purposes
  • Not attempt to circumvent security measures
  • Not use automated systems to access the Service without permission
  • Exercise independent judgment regarding sailing safety

The Service, including its original content, features, and functionality, is owned by Full Stack (Pty) Ltd and is protected by international copyright, trademark, and other intellectual property laws. Weather data is sourced from third-party providers and remains subject to their respective terms.

8. Third-Party Data Sources

The Service incorporates weather data from various third-party sources including NOAA, ECMWF, DWD, and others. This data is provided under open data licenses. We are not responsible for the accuracy or availability of third-party data.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to Terms

We may revise these Terms at any time by updating this page. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
